At AchieveCard™ we take our ethical responsibilities and your privacy seriously by recognizing that your privacy is important. We have a strong commitment to providing excellent service to all our customers and visitors of the AchieveCard websites (“Websites”), including respecting your concerns about privacy. This Privacy Policy discloses how we collect personal information, the types of personal information we receive and collect, our use of prospective, current and former consumer information, information-gathering and privacy practices employed by us regarding your program (“Program”), including a Website as well as the steps that we take to safeguard your information.

If you use this site you explicitly agree to the prepaid AchieveCard MasterCard® card Privacy Policy in effect at the time of your use. If you do not agree to this policy, please do not use the AchieveCard site. We hope that this disclosure will help increase your confidence in our website and enhance your experience on the Internet. Therefore, in compliance with industry standards and regulations enforced typically by the Federal and State Governments, we abide the following Privacy Policy.

This Privacy Policy is our notice to you of:

  1. What personally identifiable information is collected from or about you;
  2. How your information is used;
  3. With whom your information may be shared;
  4. What choices are available to you regarding collection, use and distribution of your information;
  5. The kind of security procedures that are in place to protect against the loss, misuse or alteration of information under our control; and
  6. How you can correct any inaccuracies in your information.

Information Collection and Use

The sponsor of your Program is primary owner of the information collected on a Website. Other than sharing your personal information with Program sponsor and card issuer Palm Desert National Bank (the “Issuer”), and individuals and companies, including agents or business partners, which are utilized by us to provide the backbone and infrastructure for many of our operational transactions and require this information to perform these essential functions (“Authorized Third Parties”), we will not sell, share, or rent this information to others in ways different from what is disclosed in this Privacy Policy. We may gather the following types of information about or from cardholders, including but not limited to:

  • Cardholder information
  • Account information
  • Transaction information
  • Browser information

As part of our mission to keep you up to date with your account as conveniently as possible, we may include personally identifiable information, including information falling within each of the above categories, in emails we transmit to you. In general, the collection, use and disclosure of information may take place even where an online form is only partially completed by you.

Use of Account and Account Card

By participating in your Program or using your Account and/or Account card (“Account Card” or “Card”), we may collect certain identifying information about you, including your name, e-mail address, telephone number and home address. We may use this information to periodically inform you of your Account balance and transaction history and to mail your Account Card to your home address.

Your Account identification and login number will be your 16-digit Account/Card number and your initial password will be the last 4 digits of your social security number or tax ID number. After your initial login at a Website using your Card number and password, you may change your password to a more personalized password. Your Card number and password are used to verify your identity when you login at a Website. In addition, we will collect a unique personal identifier that will be used only to verify your identity when you telephone Customer Service.

Transaction Information

When you use your Account/Account Card to make a purchase at a merchant, we collect the following information from the merchant:

  • Merchant name
  • Transaction description
  • Amount purchased

Browser Information

We gather information from your browser that identifies your computer's capabilities. We use this information to help administer a Website.

Cookies

We also use a feature of your browser to place “cookies” on your computer. “Cookies” are small pieces of information that are stored by your browser on your computer's hard drive, that allow us to identify you and link you to your personalized Account. If you choose not to accept our cookie, you will still be able to use the functions of a Website, but we will not be able to store your Card number for future use.

Short Message Service

As part of our mission to provide you with the most readily available access to information relating to your Account, we may provide a service through which you can receive messages on your wireless device via short message service (“SMS Service”). In addition to any fee of which you are notified your provider’s standard messaging rates apply to our confirmation and all subsequent SMS correspondence. All charges are billed by and payable to your mobile service provider. We will not be liable for any delays in the receipt of any SMS messages, as delivery is subject to effective transmission from your network operator. SMS message services are provided on an AS IS basis. If fees are charged to your wireless account invoice, we may provide your carrier with your applicable information in connection therewith. Your wireless carrier and other service providers may also collect data about your wireless device usage, and their practices are governed by their own policies.

You acknowledge and agree that the SMS Service is provided via wireless systems which use radios (and other means) to transmit communications over complex networks. We do not guarantee that your use of the SMS Service will be private or secure, and we are not liable to you for any lack of privacy or security you may experience. You are fully responsible for taking precautions and providing security measures best suited for your situation and intended use of the SMS Service. We may also access the content of your account and wireless account with your carrier for the purpose of identifying and resolving technical problems and service-related complaints.

You may opt out of communications through our SMS Service. If you opt out your SMS number will no longer be used by us provide correspondence to you. You may opt out by sending your request in writing via email to support@achievecard.com or by sending "STOP", "END", "QUIT" to the SMS text message you have received.

Sharing of Information

The information we collect may be shared on an aggregate and statistical and/or personally identifiable basis with Authorized Third Parties. Authorized Third Parties do not release this information, other than for transactional purposes, or utilize it for any promotional activities. We utilize the services of Authorized Third Parties to issue Accounts and/or Account Cards. It may be necessary to disclose customer information to these parties in order to provide the services offered by your Program.

Aside from sharing your information with Authorized Third Parties as discussed above, we may disclose information to third parties about your Account transaction history:

  • Where it is necessary for completing transactions;
  • In order to verify the existence and conditions of your Account and funds for a third party, such as a credit bureau or merchant;
  • In order to comply with government agency or court orders, or other legal reporting requirements;
  • If you give us your written permission; or
  • Within our organization and to the Issuer.

Information concerning your Card transaction history may be shared within our organization and with the Issuer. Other information you have given us in connection with obtaining a Card, or information we may receive from other third party, also may be shared within our organization and with the Issuer.

We may use and share your information to provide customer services, to process claims for lost or stolen Cards, to develop marketing programs, to help protect against fraud and to conduct research and analysis. In addition, it is often necessary for us to disclose cardholder information for the same purposes to companies that work with us. For example, we may provide certain cardholder information to companies that perform business operations or services, including marketing services, and fraud detection services on our behalf.

We may share certain types of information to third party advertisers or marketers (“Advertisers”) in order to provide you with information about additional products and services that may be of interest to you. You have the choice to opt out from our sharing of information with Advertisers by contacting us at the contact information set forth below.

You may wish to directly provide third parties with your personal information in order to receive services or merchandise. Third parties have their own privacy policies over which we exercise no control. Before providing personal information to third parties, you should refer to each third party's privacy policy for complete information about the collection and use of personal information on their website. Each third party's privacy policy, and not this Privacy Policy, governs how information that you provide directly to them is used. We have no responsibility for the privacy policies and other aspects of websites that we link to, including the content of those websites and any cookies those websites might deposit on your hard drive. We provide these links solely for the convenience of cardholders.

Security

We believe that your personal informationand financial transactions are extremely sensitive and deserve suitable safeguards so we strive to maintain the highest levels of security. In that regard, we conduct reviews of a Website's security protocols regularly. To ensure the security of a Website and information you provide to us, we employ the following safeguards:

Secure Socket Layer Technology. All Internet transactions are protected by Secure Socket Layer (SSL) encryption technology. Information that is protected by SSL cannot be decoded or read during transmission because it is encrypted on your computer, sent through the Internet as scrambled code, and decoded on our secure server. The Netscape Navigator, Microsoft Internet Explorer and America Online Web browsers each support SSL, and responsible websites use this protocol to protect user information. We never accept or transmit sensitive cardholder information over the Internet without this security.

Firewalls. We store information that you provide on a secure database. This information is accessed only to fulfill orders and answer account-specific queries. We use firewalls to restrict access to our secure servers to authorized persons and to block the entry of hackers and others with dishonorable intentions.

Limited Internal Access. Internally, we restrict access to personal information to employees, such as customer service representatives, who need the information to perform their jobs. These employees are limited in number and may only access this information when necessary to perform their duties. All employees are trained extensively about our security policies. An employee's failure to abide by these policies constitutes grounds for immediate dismissal.

Passwords. In connection with the use of your Account (and Account Card if offered by your Program), you will have an Card number and a password to establish your identity. To access your Account online, you must use your Card number and your password.

Card Verification Number. In an effort to prevent fraudulent use your Account Card (if offered by your Program), each Account Card is assigned a certain Card Verification Number. A Card Verification Number is the last three digits added to your Card number that is printed, and not embossed, on the reverse side of your Account Card and can be found in or near the area designated for your signature. The Card Verification Number is a further means of identifying a holder of the Account Card.

Third Party Submitted Information

When you use your Account (and Account Card if offered by your Program) to obtain goods or services from a merchant, information from the merchant as to the merchant's name and the total dollar amount of the transaction will be provided to us.

Collection of Information from Children

We do not knowingly establish Accounts for (or issue Account Cards to, if available for your Program) or collect information from children who are under the age of thirteen (13). The services offered by your Program are not available to children under the age of thirteen and this Program Website is not intended for them. If you are under eighteen (18) years of age, you may not use the services offered on our web site unless they are used with the consent, permission and supervision of your parents or guardians.

Changes to this Privacy Policy

We reserve the right to change, amend or update this Privacy Policy upon prior notice posted on a Website. If we do decide to change the Privacy Policy, we will post those changes here so that you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Continued use of the services offered by your Program or a Website after any posted change indicates your consent to use your information in accordance with the changed, amended, or updated Privacy Policy. If at any point we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify you by way of e-mail. You will have a choice as to whether or not we use your information in this different manner.

Your Responsibilities

We cannot ensure your privacy if you do not protect yourself. Do not reveal your password to anyone. You will not be asked for it by anyone connected to us. If you are suspicious of any request for information, contact us immediately. We will not be responsible for activity in your account that results from your failure to keep your password secure.

Correction/Updating Personal Information

If your personally identifiable information changes, you can notify us of the changes at the My Account section of a Website or by contacting Customer Service

Improper Conduct/Forced Disclosure

This Privacy Policy shall not apply in the event that you engage in certain improper conduct. Specifically, we shall have the right to use or release to third parties, including state, local, and federal authorities, personally identifiable information regarding users who are suspected of having used a Website or any website connected with the services offered by your Program for any fraudulent purposes or having otherwise violated any law, rule, regulation, the Terms and Conditions, having engaged in any conduct which we deem improper. We will disclose any information we hold if required by a court order, subpoena, or other legal means.

Consent

By using a Website or using the services offered by your Program, you are consenting to the collection, storage and disclosure of information as described in this Privacy Policy and our Terms and Conditions or Cardholder Agreement (“Terms and Conditions”).

Business Transfer

As with any other business, it is possible that AchieveCard in the future could merge with or be acquired by another company. If such an acquisition occurs, the successor company will have access to the information maintained by AchieveCard, including customer account information. Any successor company will continue to be bound by this Privacy Policy.

Special Notice for California Residents

The following applies to California residents. As discussed above, we may, from time to time, share certain types of personally identifiable information with unaffiliated third parties for their direct marketing purposes. As a California resident, you have a legal right to request and receive in writing or by email the names and addresses of all such third parties who received your personally identifiable information during the previous calendar year and a list of the types of personally identifiable information disclosed to such third parties.
